Cybrarium Rules of Conduct
The Cybrarium strives to provide a welcoming environment for all patrons. The following rules of conduct are meant to ensure that the Cybrarium is a safe and enjoyable place. Cybrarium staff shall have the right to contact the proper authorities and ask individuals to leave the Cybrarium when individuals are in violation of these rules. Violation of Cybrarium policies or any unlawful behavior may result in the loss of Cybrarium privileges.
The Cybrarium expects patrons to:
- Attend to personal belongings. The Cybrarium is not responsible for personal belongings left in or on Cybrarium property.
- Use restrooms only for their intended purpose. Bathing is prohibited.
- Wear shoes and shirts.
- Maintain bodily hygiene in a manner that does not constitute a nuisance to other persons.
- Use covered containers when bringing beverages into the building and comply with posted ‘No Food’ and ‘No Drink’ zones.
- Use Cybrarium furniture, equipment and materials for their intended function.
- Follow established loan procedures or authorizations before taking Cybrarium property or materials from the building.
- Cooperate with staff.
- Use all Cybrarium areas, including parking areas, sidewalks and lawns, safely.
- Not enter non-public areas.
- Leave the Cybrarium at the designated closing time.
- Refrain from solicitation of any kind for any purpose unless it is a Cybrarium sanctioned event.
- Leave modes of transport (e.g., bicycles, scooters, roller-blades, etc.) outside of the building.
The following actions and forms of conduct are not permitted:
- Sleeping.
- Harassing or speaking abusively to staff or patrons.
- Mutilating or destroying buildings, materials or equipment.
- Bringing animals and pets into the Cybrarium, with the exception of service animals.
- Loitering outside the building in a way that creates a reasonable concern for the safety of persons or property as set forth in § 614.106, Ord. Code, § 856.021, F.S.
- Behaving in an unlawful, disruptive or potentially harmful manner.
- Blocking or interfering with the movement of individuals or bringing in items larger than 26”Lx16”Wx16”H, or present a potential danger.
- Engaging in sexual activity of any kind, sexual harassment or indecent exposure.
- Consuming or possessing alcohol, illegal drugs or being under the influence.
- Smoking and use of tobacco products.
- Monopolizing Cybrarium equipment, materials or facilities by preventing others from using them.
- Carrying illegal weapons of any type.
- Disturbing other patrons with noise producing activities.
- Damaging, destroying or stealing any patron or employee’s property.
- Any use of computers or Internet access that interferes with the activities of the Cybrarium or its network, or is in violation of federal, state, or local laws. Displaying sexually suggestive objects or pictures may be a violation of State and Federal Obscenity laws (Florida Statutes 847.001, 847.0133, 847.0135; Title 18, United States Code, Section 2252).
- Violating any of the Rules of Conduct.
The Cybrarium reserves the right to require anyone violating the Rules of Conduct to leave the building. Anyone who is required to leave the building due to a violation of the Rules of Conduct will not be permitted in the Cybrarium for the remainder of the day. Violations may result in the patron being barred from the Cybrarium for a period of one (1) to seven (7) days.
Serious or repeated misconduct may lead to legal action or criminal prosecution. The Cybrarium considers the following activities to be serious violations of the Rules of Conduct:
- sexual activity of any kind, sexual harassment or indecent exposure
- consumption or possession of alcohol or illegal drugs
- Smoking and use of tobacco products
- possession of illegal weapons of any type
- mutilating or destroying the building, materials or equipment
- repeated offenses of any kind
Anyone who engages in these activities will be required to leave the Cybrarium. Serious violations will result in the suspension of an individual’s privileges and being barred from the Cybrarium for one (1) year from date of suspension.
Exceptions to these Rules of Conduct may be granted at the discretion of the Director or designee.
In the event the Cybrarium determines that an individual shall be barred for any period of time greater than one (1) day, the Cybrarium shall provide such individual written notice of said bar, the duration of the bar, and the reasons for the bar. This notice shall be referred to as an order of trespass.
Disputing a trespass
The City establishes the following process to be used by individuals to whom an order of trespass has been issued should the individual wish to dispute or appeal their barring from the Cybrarium. If the individual chooses not to use this process, the order of trespass shall remain in effect for the full period included in the order of trespass.
The barred individual must file an appeal in writing to the Director within thirty (30) days of the receipt of the order of trespass. The Director or designee will schedule an appeal hearing with the individual within fourteen (14) days of receipt of the request to appeal. At the appeal hearing, the individual will have the opportunity to present any information or otherwise explain factors the individual deems relevant to overturn or reduce the duration of the bar. The staff person responsible for the order of trespass will present information related to the rationale for barring the individual from the Cybrarium. The sole issue to be determined by the Director or designee is whether the Cybrarium’s bar and the duration of the bar are "clearly erroneous," as defined under Florida law. The Director or designee may vacate, modify or uphold the order of trespass. Unless deferred, The Director or designee will render a decision about the appeal within seven (7) business days of the hearing and shall notify the individual and appropriate staff members in writing.
