Video Surveillance

  1. VIDEO SURVEILLANCE

    The Cybrarium is committed to serving the public by providing a safe place for all patrons and staff members.

  2. CAMERA PLACEMENT AND MONITORING

    Security cameras are placed in locations meant to provide maximum security, including building interiors and exteriors. In no event shall cameras be located in areas where patrons or staff have a reasonable expectation of privacy, including but not limited to restrooms, staff break rooms, and offices. Security cameras will be placed to avoid recording legible computer screens, tabletops, or other locations that would identify the reading or information-gathering practices of individuals. Audio surveillance is not permitted under this policy.

    Video surveillance footage is not continuously monitored. Therefore, Cybrarium patrons and staff should take appropriate precautions for their safety and for the security of their personal property.

    Video surveillance footage will not be retained or archived for any period exceeding 30 days, unless such footage is needed to document possible criminal activity or violations of the Cybrarium Policy. As new footage is recorded, the oldest footage will automatically be deleted.

  3. ACCESS

    Pursuant to Section 281.301, Florida Statutes, all video surveillance footage or information relating to the security or fire safety systems for the Cybrarium are confidential and exempt from the public access and disclosure requirements provided in Section 119.07(1), Florida Statutes and Section 24(a), Art. I of the Florida State Constitution.

    However, such confidential and exempt information may be disclosed:

    1. To the property owner or leaseholder;
    2. In furtherance of the official duties and responsibilities of the agency holding the information;
    3. To another local, state, or federal agency in furtherance of that agency’s official duties and responsibilities; or
    4. Upon a showing of good cause before a court of competent jurisdiction.

    Upon receipt of any inquiry, process, order, or subpoena seeking video surveillance recordings, the matter will be turned over to the Director or designee. The City Attorney will determine if such inquiry, process, order, or subpoena is in proper legal form. The Director or designee will be authorized to release images to law enforcement or another local, state, or local government agency.

    Nothing in this policy shall prevent authorized Cybrarium personnel from using video surveillance records in the administration of their regular duties.
